WETLAND CONSERVATION ACT(WCA) The Lyon SWCD is the Local Government Unit (LGU) in Lyon County for the State of MN Wetland Conservation Act.
There are several things that landowners need to be aware of pertaining to this law and Agricultural and non-agricultural land. They are: Filling: meaning that any solid material added to a wetland that would alter its characteristics, obstruct the flow, change the wetland boundary or convert the wetland to a non-wetland. It may not include posts, pilings used for bridges, elevated walkways, or power lines, docks. But should those items in anyway result in changing characteristics they would not be allowed. Draining: any method of removing or diverting waters from the wetland, this includes but is not limited to ~ excavation of an open ditch, installation of subsurface drainage tile, filling, diking, or pumping. This would also include the use of the moldboard plow in creating a furrow to drain the wet area. Excavation: Is the displacement or removal of sediment or other materials by any method.
